Welcome to Aipa. These Terms of Service ("Terms") govern your access to and use of Aipa's AI assistant service, including our website, API, and any associated services (collectively, the "Service") provided by Aipa LLC. ("Aipa", "we", "us", or "our").

Our Service provides AI-powered assistance that learns and evolves to better serve your needs. By using Aipa, you agree to these Terms, which establish clear guidelines while protecting both your rights and our ability to provide and improve the Service.

If you do not agree with these Terms, please do not use the Service.

1. Service Description and Evolution

1.1. Aipa is an AI-powered personal assistant designed to learn from interactions and provide increasingly personalized support. The Service includes our AI technology, user interface, and any associated features or functionalities.

1.2. As an evolving technology, our Service continuously improves and adapts. We may modify, enhance, or update features and functionalities over time to better serve our users.

1.3. The Service may include various access levels, usage limits, or service tiers. We reserve the right to implement, modify, or remove such limitations as needed to ensure service quality and sustainability.

2. User Rights and Responsibilities

2.1. Account Creation and Security

- You must provide accurate information when creating an account

- You are responsible for maintaining the security of your account credentials

- You must notify us immediately of any unauthorized access or security concerns

2.2. Acceptable Use

- Use the Service in compliance with all applicable laws

- Both you and Aipa may use, store, and process interactions and outputs

- You receive a perpetual license to use outputs for your intended purposes

- We retain rights to store and learn from these interactions to improve our Service

3.2. When using our Service:

- You grant us necessary rights to process your inputs and provide the Service

- You may use outputs for both personal and commercial purposes within reasonable usage limits

- Multiple users may receive similar outputs as AI responses are not exclusive

- We cannot guarantee unique or original outputs

3.3. The Service's outputs are provided to assist you, with the understanding that:

- You are responsible for reviewing and validating outputs for your use case

- We cannot guarantee specific outcomes or results

- Fair usage limits apply to all use cases to ensure service quality for all users

4. Data Processing and Privacy

4.1. Our processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms.

4.2. We implement a two-tier learning system:

- Personal learning stays within your account

- General service improvements use anonymized patterns with opt-in consent

5. Service Availability and Support

6.3. We respect intellectual property rights and expect users to do the same when using our Service.

7. Limitations of Liability

7.1. The Service is an AI-powered assistant tool, and accordingly:

- We do not guarantee specific outcomes or results

- You are responsible for reviewing and validating outputs

- We are not liable for decisions made based on Service outputs

7.2. Our liability is limited to the maximum extent permitted by law. In no event shall we be liable for:

- Indirect or consequential damages

- Lost profits or data

- Damages exceeding amounts paid for the Service

7.3. These limitations apply to all claims, whether based on warranty, contract, tort, or any other legal theory.

8. Term and Termination

8.1. These Terms remain in effect while you use the Service.

8.2. You may stop using the Service at any time.

8.3. We may suspend or terminate access if we reasonably believe:

- Continued access could harm the Service or other users

8.4. Upon termination:

10.3. You and Aipa LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
